1. Agreement to Terms
These Terms of Service ("Terms") are a contract between you and Brand Lew LLC ("BrandTrust," "we," "us"), which operates BrandTrust.reviews and its embeddable widgets and WordPress plugin (the "Services"). By creating an account or using the Services you agree to these Terms and our Privacy Policy. If you use the Services for an organization, you represent that you are authorized to bind it.
2. What the Services Do
BrandTrust lets you connect your own accounts on supported review platforms — currently Google (Business Profile), Facebook/Meta, Etsy, eBay, and WooCommerce (your own online store) — and display your existing reviews on your website through widgets and a WordPress plugin. We aggregate and display reviews; we do not host, solicit, generate, or alter reviews. At your direction, we may also submit a reply you write back to the source platform (for example, replying to a Google review); you are solely responsible for the content of any reply you post. Availability of any particular platform depends on that platform's API and terms and may change, and we may add, remove, or limit integrations at any time. Some features and integrations may be offered on a beta or trial basis and provided "as is."
3. Accounts and Eligibility
You must be at least 18 and provide accurate information. You are responsible for your credentials and for activity under your account. Notify us of any unauthorized use.
4. Connecting Your Review Platforms
To use the Services you authorize us, through each platform's official authorization or API, to access your account and retrieve reviews of your business. You represent that you own or are authorized to connect each account, and that your use of BrandTrust complies with each source platform's own terms of service and developer/display policies. You may disconnect a platform at any time; we will stop retrieving from it and prune associated cached data on the next sync.
5. Source-Platform Terms and Attribution
Reviews and related content remain subject to the terms and intellectual-property rights of the originating platforms and their reviewers. We retrieve content through official APIs and cache and refresh it consistent with those platforms' requirements. You agree not to remove or obscure source attribution (platform name/logo) that the Services display, and not to use the Services in a way that violates a source platform's terms. Platforms may change, limit, or terminate API access; we may modify or discontinue a given integration accordingly, without liability.
6. Display Controls and Fair Presentation
The Services provide controls over how your reviews are displayed, including a minimum star-rating filter, keyword filters, and the ability to exclude specific reviews from the displayed cards. The overall star rating and total review count shown by the Services are computed over all reviews retrieved from the source platform and are not changed by these display controls. You are solely responsible for using these controls lawfully and honestly. You agree that you will not use the Services to present reviews in a way that is deceptive or that misrepresents the overall sentiment, rating, or volume of reviews about your business, and that your use will comply with applicable consumer-protection law, including the U.S. Federal Trade Commission's Rule on the Use of Consumer Reviews and Testimonials (16 CFR Part 465) and the FTC's Endorsement Guides. In particular, you will not use display controls or any other means to suppress genuine negative reviews in a manner that misleads consumers, and you will not use unjustified legal threats to remove honest reviews.
We do not create, write, buy, or alter the substance of reviews. We may, at our discretion, decline to display content, require accurate presentation, or suspend configurations or accounts that we reasonably believe violate this Section or applicable law.
7. Consumer Review Fairness Act
Consistent with the U.S. Consumer Review Fairness Act, any contract term that bars or penalizes honest consumer reviews is void; nothing in these Terms restricts consumers' right to post honest reviews of their experiences.
8. WordPress Plugin
The BrandTrust WordPress plugin is provided to eligible plans and is licensed under the GNU General Public License, version 2 or later (GPLv2+); that license governs the plugin's code. The plugin connects to our Services using a sync key issued to your site to retrieve your widget data, which it stores locally on your WordPress site and may include downloading review images and reviewer photos into your site's media storage so they are served from your own server. You are responsible for securing your WordPress site and sync key. Because the plugin renders reviews on your own server, impressions delivered through the plugin are not counted toward your plan's monthly view limit (only reviews delivered through our JavaScript embed snippet are counted). If your subscription lapses, the plugin will stop displaying reviews and may remove locally cached review data.
8a. Team Members and Projects
Some plans let you invite additional users ("team members") to your account and organize widgets into projects with role-based access. You are responsible for the users you invite, for assigning appropriate access, and for their compliance with these Terms; their actions under your account are treated as your own. You are responsible for promptly removing team members who should no longer have access.
9. Fees, Plans, and View Limits
Paid plans, features, and monthly view limits are described at https://brandtrust.reviews/#pricing or your order. Monthly view limits apply to reviews delivered through our JavaScript embed snippet; reviews delivered through the WordPress plugin are rendered on your own server and are not counted toward the limit. Billing is handled by Stripe; by subscribing you also agree to Stripe's terms for the payment portion. Fees are non-refundable except as required by law. We may change pricing on prospective notice. If you exceed your plan's view limit or your subscription becomes inactive, widgets may stop serving until resolved. You may cancel at any time via the billing portal; cancellation takes effect at the end of the current period unless otherwise stated.
10. Acceptable Use
You will not: violate law or third-party rights; use the Services to display reviews you are not authorized to display; scrape, reverse engineer, or interfere with the Services; circumvent view limits or access controls; introduce malware; or misuse the widgets, plugin, or APIs. We may suspend or terminate access for violations.
11. Intellectual Property
The Services — including our software, designs, and trademarks — are owned by Brand Lew LLC or our licensors. We grant you a limited, revocable, non-transferable license to use the Services and to embed our widgets and plugin on websites you control, solely as intended. Reviews and platform content belong to the reviewers and source platforms; nothing here transfers those rights to you.
12. Third-Party Services and Sites
The Services depend on and interoperate with third parties (including the source platforms, Vercel, Supabase, Stripe, and Google Fonts). We are not responsible for third-party services, their availability, or their content, and your use of them may be subject to their terms.
13. Disclaimers
THE SERVICES AND ALL REVIEW CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS, TIMELINESS, OR AVAILABILITY OF REVIEWS OR PLATFORM DATA. We do not guarantee uninterrupted access to any source platform's API. Some jurisdictions do not allow certain disclaimers, so some may not apply to you.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAND LEW LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF US$100 OR THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Nothing limits liability that cannot be limited by law.
15. Indemnification
You will indemnify and hold harmless Brand Lew LLC from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Services, your connected accounts and content, your configuration and presentation of reviews, or your violation of these Terms, a source platform's terms, or applicable law.
16. Termination
You may stop using the Services and cancel at any time. We may suspend or terminate access for violation of these Terms or to protect the Services or others. On termination we stop retrieving your reviews and delete associated cached data as described in the Privacy Policy. Sections that by their nature should survive will survive.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws rules. The state and federal courts located in Maricopa County, Arizona have exclusive jurisdiction over any dispute relating to these Terms or the Services, and you consent to personal jurisdiction and venue there. To the extent permitted by law, you and BrandTrust each waive any right to a jury trial and agree that disputes will be brought on an individual basis and not as part of a class or representative action.
Consumers in the EEA/UK and certain other jurisdictions may retain mandatory local rights that these provisions do not override.
18. Changes
We may update these Terms and will post the updated version with a new date, providing additional notice for material changes where required. Continued use after changes take effect means you accept them.
19. Miscellaneous
These Terms and the documents they reference are the entire agreement regarding the Services. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign in connection with a merger, acquisition, or sale.
